Recieved H1B petition notice and within 3 days recieved denial notice.

Hi,

After responding to a RFE, My employer received H1B petition approval notice on Dec-1 and right after 3 days he also received denial notice stating RFE response was not received on time. My Employer had sent RFE response before the deadline. Our attorney says we can consider the petition to be approved and since my wife is already in US, she can go get the SSN. Has anyone faced this issue?

you have to go by whichever petition has the latest date. You can’t just “consider” - you need to contact USCIS to confirm
