Asking on behalf of my friend.
My friend works for employer A and entered the USA for the first time on Jan 1st 2015 (H1B Maxout would be Dec 31st 2021). She took a vacation for 30 days in 2018 and when an extension was filed after the vacation, the attorney recaptured the 30 days and calculated the Maxout as Jan 30 2022. After the extension, she got another opportunity with employer B and an H1B transfer is about to be initiated. The attorney at Employer B says, since she had previously requested to recapture time she spent out of the US, they can’t request again and hence the Maxout would be Dec 31st 2021. Is it correct?
