Hi team,

I have one H1B approved petition until April 2016.my employer applying extension. I come to USA with this approved H1B.my visa have this petition number

.i also have other H1B approved petition until Oct 2016.its just approved petition .

After April what is my status if extension take time? Is my status is out of status or H1B?

As long as the extension is filed prior to current petition’s expiration date, you will be considered in-status. You can stay for up to 240 days beyond current I-94 expiration date with such a pending extension petition.

I assume your I-94 has April 2016 expiration date and not Oct 2016.
