Question regarding replying to an RFE on L2-EAD Extension.

Both my L2 Visa & I-94 is valid till March/25th/2017.

My spouse’s L1 Visa validity is till Aug/28th/2016 And I-94 till Sep/28th/2016.

Both L1 & L2 are applied for extension on Sept/13th/2016 still in process (Meaning we have I-797 and I-539 notice receipts in our hands).

Since my L2-EAD was valid till July/23rd/2016, I have applied for EAD extension on June/15th/2016. For this I got an RFE asking for the following…

" Principal’s I-94 Non-immigrant Arrival/Departure Record
You must provide a photocopy of the front and back of your Spouse’s Form I-94 (Arrival/Departure Record) or your Spouse’s most recent I-797 Approval Notice authorizing an extension or change of status.

If the Form I-94 for the principal alien is not available, submit a copy of the page(s) from his/her passport establishing admission into the United States."

Could you please suggest him how to go about it, like the letter format/what to mention in the letter.

You can’t use extension receipts to respond to the RFE. You can’t use I-94 copy either as that date is expired for the primary applicant. I suggest sending in copy of the passport pages as proof of admission into US. A letter is not required. You will highlight the line " …submit a copy of the page(s) from his/her passport establishing admission into the United States" in a copy of the USCIS letter, place it on top and highlight the most recent admission stamp in passport page copy. Send these two documents in as a response.
