Hi Saurabh,

My H1b was denied and I applied for MTR. My H1b finally got approved on Dec 12th. My employer received I797C approval notice with valid dates. I haven’t received my original documents yet, not sure how long it would take to receive them. Please let me know if there is any way that I can know my COS is also approved? I am currently enrolled in a school. Now due to this H1b approval, will my SEVIS be automatically terminated? If it is terminated, does it mean my COS is approved? Please confirm.

You said that employer received 797C approval notice. So does that notice has I-94 attached to the bottom of it? If USCIS has sent 797C as approval notice, then I don’t think they will send anything else.

Ask your school to check your SEVIS record to see if it is still open. That may give an idea about COS. Your attorney can also follow-up w/ USCIS as to why COS was not approved.
