Hi All, I am working in US on H1B Visa and my wife is on H4 Visa. Initially, our Visa expiry date was 30th September, 2016. In the month of August,2016 Visa extensions were filed for both of us at the same time. Recently my H1B extension was upgraded to Premium and it got approved on 5th April, 2017 and I haven’t yet received the hard copy of my petition. And my wife’s H4 Visa is not yet approved in USCIS website. Initially, I-94 expiry date for both of us was 30th September, 2016 and therefore, the 240 day limit ends on 28th May, 2017. Can my wife stay in US even after 28th May since my H1B has got approved? Or she has to travel back to home country if her H4 doesn’t get approved by 28th May,2017? Please respond.
If the petitions were filed together, then one PP should have upgraded both.
I would suggest attorney to contact USCIS and follow-up on wife’s case.
