Premium processing fee refunds ?

Hi All,

My wifes H1B amendment was under PP in Feb with in a week of applying there was an RFE, In March employer responded with the documents its been 65 days since employer responded but USICS never acknowledged the receipt of the documents though attorney has been calling USCIS every week.

Does this mean we can cliam for PP fee refund ? or PP time lines doesnt work for RFE ?

You are eligible for PP refund if USCIS didn’t process RFE response within 15 calendar days.

Can your attorney show that USCIS received the documents through tracking number receipt etc?
