My H1B is maxing out on 25-March-2020

Questions:

  • If my PERM gets approved and I-140 is not approved, by 25-March-2020 – Can I continue my stay in USA on H1B, post to 25-March-2020? If no, can I enter back to USA once my I-140 gets approved?

  • Please guide about best option to maximize stay in USA, considering my employer will not able to file PERM, before 365 days of maxing out on 25-March-2020.

No

i140 has nothing to do with your entry into United States.

No

You PERM has nothing to do with your entry into United States.

For this case, you need to stay one year out side United States and apply for your new H1 under Cap.
