I did my Masters (MBA) and have 1 year OPT.(Sep 7 2015 to Sep 6 2016).I am currently working in a company.I applied for H1B through an external consultant and its status is in RFE.I have two questions:1.Now assuming that my H1B is approved ,can my current company transfer H1b from external consultant immediately?If yes what should my current company do?2. What should I do from SEPT 6th to OCT 1st ?

please guide.

  1. They should be able to file cap-exempt petition for you w/ a start date of Oct 1.

  2. You should have received cap-gap I-20 from your school. If not, then talk to DSO and ask him to issue the updated I-20 for the same.
