My friend is working on L1B at client location in US. The client wants to take him on their payroll but is not able to because of the contract between the employer and the client. As per the contract, my friend can join the client a year after he leaves the employer.
Is there any way to get out of this situation? Please let us know if he has any options by which he can take up the client's offer. Any help will be appreaciated. Thanks!!
Non-compete clauses shouldn’t be taken lightly. My suggestion would be to show that contract to a good labor attorney and know the rules in your concerned state.
Thank you for your response. The client says they don’t want to get into legal stuff and asking my friend to look for any other way they can hire him. Should we still check with an attorney in this case?
