My I-129 got denied on April 9th,2018. Can i re apply under cap exempt ?

Hi,

My H1B visa got expired on 30th October,2017. I have stayed in US from April-Nov 2017 and returned back to US after applying for Extension and getting the receipt for the same. I got an RFE and now the status was denied due to speciality occupation document.

  1. If i go for appeal what is the timeline i am looking for.?

  2. Can i apply for extension again under cap exempt now? Or is there any cooling period for the same? I have file my earlier extension on Sep 1st ,2017 and received receipt on Sep 27th ,2017.
