Hi, My company applied for H1B and it got selected in lottery, later got RFE and converted to Premium processing, my petition got rejected. Can i consider my case as cap-exempt and file for H1B fresh application as cap-exempt?
No, you are not cap exempt. You need H1B approved and usually stamped or worked on H1B status with COS option to be cap exempt.
