I came to US in Feb 16 in H1B Visa with validity till Oct’16. My Role is chosen with Wage Level III in LCA. With revised wages, my current wage is well below level III for that role. I am going to file for extension. Is it okay to file for extension with wage reduced to level II, as my employer can’t pay wage for level III. My role and location is not changing from original petition.
They can file LCA for new role and then H-1 petition for the same. USCIS may feel that you are over qualified for the position. Your attorney will have to take care of that during the filing.
