LCA is certified but now prevailing wages are increased by the time H1B Extension is applied

Hi,

My LCA is approved in last month till 2022 and my employer is filling H1B extension but recently USCIS increased prevailing wages which is high than my approved LCA range and my salary. My attorney saying it is not an issue as my LCA is approved according to wages level in that month and wages changes applicable to new LCA from this month but I want to know will it create problem for my H1B extension?

In general, USCIS and all agencies look at the certified LCA. As long as the LCA is valid, it should be fine. I understand your concerns, but once certified by DOL, then that is valid until the end of its life.
