L1B to H1b COS with Travel which is my status?Does Last Action Rule Apply

Hello,

Now that my H1 is approved i am in a delima? Since i travelled bk to my home country while my H1b with COS was pending and did return bk on L1b Old visa which is valid till Sept 2013 and hence i got to know that my H1b with COS got approved which is my actual status? and if i am yet not on H1b can i reapply for COS only? How to reapply for H1b COS ?

The employer can file for just the COS from L-1 to H-1. I think it’s form I-539.
