L1B to H1B and L1B extension in parallel?

Hi, am currently in US and I have a L1B valid till Jun 9th 2014 and I94 till nov 2015.am applying L-H conversion through same employer for this year H1B cap. I need to go to India for personal reasons by May 1st week or Jun1st week. The questions are as follows:

  1. can we apply L1B extension from India if L-H is missed on lottery process(in case)?

  2. I heard there may be lottery selection for this year H1 cap, in that case then can i also apply for L1B extension from US and do the premium processing and get the result in 15 days. If we do that what is the % of getting it approved because heard recently lot of L1B is getting rejected.

  3. If i apply L1B extension and go in the middle will it be valid or the extension gets rejected?

4)What will be wise decision to make a) apply for L-H, also apply for L1B extension (pp) and get any of it approved and go back to India b) apply for L-H and wait for it to be selected in lottery then go to India

5)when will I know whther we are selected in the lottery process or not.

Am totally confused,Can you please help me out on this.

  1. They can file L-1 I-129 for you while you are in India and you can appear for L-1 visa stamping thereafter. This will be the L-1 extension process when you are outside US.

  2. PP doesn’t improve or detriorate the chances of approval. It will still remain the same.

  3. Your extension will still be processed but EOS (extension of status) will be abandoned as you left US. You will have to appear for L-1 visa stamping and then return to US.

  4. Depends how soon you want to return to India. Irrespective of what happens to your H-1 petition, you need to apply for L-1 extension as it expires in June and H-1 cannot start until Oct.

  5. If you applied in regular processing, then you should know sometime in May-June.
