L1B premium to H1b visa conversion process

Hi,

I want simple reply from you about the process of L1B to H1B conversion.
I am presently working in USA for 1year with L1B. I want to convert to H1B.

My question is that ,

  1. Is my new employer has to sponsor/submit the H1B petition or I have to do it by my self?

  2. How much is going to cost for this conversion approx?

  3. Can you help me the process flow chart for L1B to H1B please ?

4.My wife is in L2 dependent visa,what will she need to do when I will be transfered to H1B visa?

Please answer the questions as soon as possible.

  2. H-1 costs are listed on USCIS site and on the main blog. I don’t remember the exact amount but it can vary from 2K-4K depending upon employer size and proportion of H-1/L-1 employees

  3. Find an employer willing to file H-1 for you. They file the H-1 along w/ COS and you wait for it to get approved. Once approved w/ COS, you can start working on H-1 from Oct 1 (COS effective date)

  4. She will need to move to H-4 when you move to H-1. Her L-2 to H-4 COS needs to be filed along w/ your H-1

Just wants to confirm ,can we have both L1B and H1B status at the same time ,or once H1B will be approved ,L1 B status will be invalid?

You won’t have both status at the same time. The status is determined by I-94 and the most recent I-94 determines the status. So you will remain on L-1 and L-2 status until Oct 1. Then H-1/4 COS goes into effect (H-1 COS approval comes w/ its own I-94 w/ start date of Oct 1), and your status will change to H-1 and H-4.

You may posses multiple unexpired visa stamps in the passport, but you will have only 1 status inside US. You can switch back and forth b/w different statuses though. This means, your spouse can move from H-4 status to H-1 status in future, or you can move from H-1 status to L-1 status.
