L1b Extention Denied. Visitor visa on medical grounds

Hi, 

My L1b visa and I94 are expiring on Jan 2013. My wife is 30 weeks pregnant 

hence we are not in a position to travel back to our country. My company is 

applying for my L1b extention

 

If my L1b extention is denied after my current I94 expiry, Can i apply for a 

visitor visa on medical grounds at that point of time and legally stay in US 

for 2-3 months so that i could safely take the baby to my country?

Yes, you can do that. Get a doctor’s letter as well stating that it is risky to travel etc etc.
