Hi, My L1A visa is maxing out (completing 7 years) in 2 months from now. My wife is on H1B, and she has an approved I-140. If I convert to H4 (as my wife’s dependent), and if I dont get my H4 approval before my L1 maxes out, am I allowed to stay in US on a H4 I-539 receipt notice even if my L1 maxes out ? Or do I need to leave US ?
Once the COS to H4 is applied before L1 max out date, your status will be in pending COS and can legally live in the US.
