L1 visa hits 5 year limit - Can we stay on H1 after L1 expires

Hi,

My L1 visa expires on Jul 2 2014. My company A is planning to apply for H1 for 2014 .

Q1 : Can i stay in USA even after L1 expires Jul 2 2014 and H1 being approved.

Q2:If my H1 gets approved thru premium processing can i immediately start working for company A ?.

  1. You can only stay if your L-1 extension has been approved or L-1 extension is pending. When is your I-94 expiring?

  2. No, you cannot. You can only work for H-1 employer from Oct 1 and that too if it has been approved w/ COS.
