L1 to H1B During 240 Grace Period of L1

Hi,

I have a L1A visa which expired on 12/30/2019. I am staying on extension filed grace period. My client is willing to file my new H1B for me (I never had a H1 before).

Questions -

  1. is L1A to H1B possible ?
  2. Can I change immediately OR only after lottery and on Oct 1st ?
  3. if my L1A extension gets denied OR RFE, what impact it will have on H1B ( assuming it gets through)

  1. Yes, they can apply as Change of Status.
  2. You need to wait until Oct 1st to work on H1B.
  3. It will not have any impact, both are different visa categories and looked separately.
