L1 to H1b COS Approved today - travelling to India tommorrow

Hi Saurabh,

I got my L1 to H1b with COS approval today. And I am travelling to India tomorrow. Actually I my employer responded to RFE last week and was not expecting approval within a week. I was expecting my COS would be abandoned once I travel India and would enter on L1.

I dont want to go for stamping process. Now my question is, Can I enter USA on my L1 visa? Will it be an issue while port of entry in US?

You can return on your L-1 visa as long as:

  • it has not expired

  • your L-1 employer still wants to hire you on L-1
