Just received an RFE today for specialty occupation.

Hello all,

After waiting for over 4 months, I finally received an rfe today for SPECIALTY OCCUPATION. I really don’t know if this is a good news or bad.

I am a full time employee in one of the most reputed companies within our industry and also my work is quite relevant to the field in which I completed my Master’s degree from one of the most renowned universities in US.

So my question are as follows:

  1. What kind of documents does USCIS expect for this type of RFE? Has anybody been through this situation?

  2. Is getting such RFE quite normal? Do I stand a chance for RFE approval?

  3. Since USCIS has responded quite late, there is a high likelihood that my RFE will not be processed before 30th September. Currently I am on CAP-GAP. So what options do I have to keep my job running even after 30th Sept?

Any suggestion / advice would be quite helpful. Thanks for your time.

Your HR did not do a good job of explaining to USCIS what makes your position a specialty occupation in the application. This should be worked out between your HR and attorney and they need to send an explanation.
