Issues with applying for L1 visa when H1 petetion is pending for approval.

My H1B is applied through a consultant (in April-2015) is pending for approval with status as “Response To USCIS’ Request For Evidence Was Received”, now my current employer wants to apply for L1 urgently.

Can I apply for L1 ? will it affect my H1 visa ?

Would it be possible to transfer the visa in the current state from Consultant to my employer ?

L-1 can be applied while your H-1 is pending. There is no H-1 transfer to L-1.

One final clarification. Lets say my current employer finishes all L1 documentation and just before I book an visa interview my H1 Petition(applied through consultant) gets approved which is currently in “Request For Evidence Was Received” state than if I attend the L1 Visa interview,

  1. will my H1 petition gets cancelled ?
  2. is there any chance it will cause problem in my L1 visa interview ?
