Is it necessary that I should employed by sponsor before applying H1B..?

Hi ,

I am currently working in MNC in my notice period and recently my H1B got approved which is sponsored by US based company.

Today my manger came to me and said “H1 visa can’t be issues to any employee unless you are an employee of that company”.

My question is , is it necessary that I should be an employee of a company before applying for H1B , if not will i face any problems at immigration ?

For a US based company with no offshore development office in India, how can anyone become an employee before reaching US ? Even for a company that has an office in India, it is not necessary that you be employed in the Indian arm to become eligible for H1 - that would be a requirement for L1.

You'll not face any problems at immigration. You just need to prepare for the interview.
