Is I-129 id required for filling H4 B visa

My H1B visa is approved and i am currently not in U.S and now i want to flle H4 B visa for my wife. Is I-129 id required for filling H4 B visa? Please help me to understand the proess for it.

As you are currently outside US, your spouse needs to only get H-4 visa stamped in the passport. No other document/process is required.

U both can go for stamping at the same time… Ur H1B approval copy or i797 will do AFAIK

Hi Saurabh,

Thanks for your response.

My employer said they need to file the H4 visa for my wife and child, which will require I-94 and I-539 and it will also include the filling cost.
Later for scheduling visa Interview there will be a seperate fees of $190.
Please confirm if this is the process and also I-94 and I-539 needs to be filled by me or by my employer.

Ur H1B is approved and U r in India… Is it?
If so, U dont need anything, U can just fill DS - 160 for U, Wife and Child… Then go for interview…

Yes my H1B is approved and i am currently in India.

So I-539 is not required to file H4 for my wife and child. I want to state here that till now i haven’t started any kind of process for h4 for my wife.

Just take Ur wife and Child along with U when U attend Interview by filling DS-160 and paying fee…

Your employer doesn’t seem well versed w/ immigration laws. Refer to Rana’s posts for the correct interpretation of the law.
