My husband just finished his MBA and we moved to SC due to his job. He is on OPT now. I am on F2, the passport stamp expired but the I-20 OPT end date is June 2015, so it’s still valid. According to the USCIS, the F1 students on post-completion OPT maintain valid F1 status until the expiration of their OPT. Thus, I understand the same applies for their F2 dependents. Is that correct?
My problem is that I went to the SC DMV to issue my SC Driver’s License and they told me I cannot issue it because my visa and I-20 are expired. They looked at my passport stamp and at the 1st page of my I-20. I told them the 1st page of the I-20 only reflects academic information and the OPT information is contained on the 2nd page, but they refused to look at it. They said they can only look at the 1st page of the I-20 and if the information is not updated on that 1st page, I cannot issue my driver’s license. Thus, they told me to go back when my visa status is “valid”.
For the record, the same happened last year to a friend in Illinois. The DMV refused to look at her I-20's OPT info because they considered it should be stated on the 1st page of the I-20 (they look at the academic end date, which is incorrect to modify).
This is very frustrating… Is there anything I can do? Should I be doing anything different?
