How to recap H1B expired in 2012, Petition filed in 2009

Hi ,

I got my H1B petition filed in Oct 2009, I travelled to US for 45 days only in Feb 2010. I again travelled on B1 from different company in 2012.

Now I am planning to join a US company for which they want to recapture my H1B. Please suggest the list of steps and procedures both me and my new organization should be aware of.

Nothing. Just give a copy of your expired H1 and also dates of your entry and exit (for each of your US trip on H1 status) and all of your I-94 copies, your passport copy(of all pages).

All these use to list down your number of days present in US on H1 status so that they can claim the remaining days on H1 status for ya

Couple of things.

  1. How much the new employer is supposed to pay for cap and transfer of H1
  2. Also when I travelled on B1, the person who took my interview in the consulate made a signature kind of striking on my H1 VISA. What does that mean?
  3. Last the new employer can directly hire me on H1 or Do I need to join their India n office and then travel from here.
