I have question related to H4 Visa Valid until next 1 year 2020 Dec (last time US consulate given 5 year Visa stamping) but the PED (petition end date) mentioned in the Visa has already expired.
The Current H4-extention petition is being pending with US.
My question is, In case of travelling out of US and returning back can we use the same Visa with Approved (new) H1B paperwork (Approval Notice), Or we need to get the new H4 stamping again ?
In general, if your H4 visa stamp is valid, you can use that to enter US, provided you have supporting H1B approval that is also valid from your spouse. I am not sure, how you got H4 stamping beyond the H1B stamping end date. The general practice is that you get H4 visa until the end of your H1B spouse’s petition end date…Could have been a mistake on the Consulate side, not sure…
I suggest you check with your attorney once on this and then proceed. You can email the embassy as well to get confirmation.
