I have a situation where in I was not sure how it will work out so posting here to understand and then take a better decision
- My wife has her H1B from her employer, she never travelled on that visa, expiration date was 10/2014.
- She moved out of that company and then later resigned from this company as well, and hence stayed jobless.
- mean while I got my H1B approved and she accompanied me on a H4.
- Once consultancy came forward saying they could convert her H4 to H1 again so that she would be able to work.
- Now her first employer from whom she actually got her H1 Visa has a job opening for her and was contacting the consultancy who was processing this conversion, these consultancy people asked us to borne the premium expenses of around 1300$ as they already invested lots of money.
- My question is rather than having us paid the premium expenses to the consultancy, can we ask her employer to convert the h1 back again on their name ?
apart from the premium processing fees what could be the possible expenses the consultancy guy was talking about ? If there is any better plan I can think of please suggest.
