I am presently in USA in H4. My husband’s H1b will expire on 31st Mar 2015 . While his company will file for an extension, can I apply H1B COS on 1st Apr 2015 if we dont recieve the extension approval by that time?
Your H4 visa is valid till your spouse’s H1 is valid only.
If your H4 extension is also filed along with your spouse’s H1 extension, you can file your COS for H1. If not, you are officially out of status after March 31st. Forget about your COS, first you should not stay in US after March end.
But you can file COS before march end
