H4 to H1. Applied SSN but they said still H4 is Reflecting in the system

I came in H4 to US last year and I have applied for a H1b and it got approved tis Jan 2013. When I applied for tis H1B my H4 also went to extension at the same time. So it got approved on feb 2013. I also have the I-94 details in my I-797A.

Yesterday I applied for my SSN card and tey said they still see the H4 details only but tey can verify with thier internal systems and they said i will receiving my SSN in 3 or 4 weeks.

Please let me know whether there will some problem in getting the SSN.

Your H-1 was approved in Jan 2013, followed by H-4 extension approval in Feb-2013.

As per Last Action Rule, your status is H-4 and not H-1. I hope you are not working as that would be illegal.

You need to file COS from H-4 to H-1, or enter US on stamped H-1 visa to move to H-1 status. After that, you can apply for SSN.

I am surprised your H-1 attorney didn’t advise you to withdraw H-4 extension or file another COS if you wanted to be on H-1.
