H4 - H1B conversion

Hello

I was working for a biotech company with a H1B visa and got laid of a month ago. To stay legal, I have filed for a H4 petition on my wife’s H1B and got an acknowledgement. I have a potetial new employer. if they are willing to file a fresh H1B (say premium processing), when will I be able to work for them? Also, as I have worked in an industry, I don’t have to worry about the “head count” for annual H1Bs right?

PS: I have an approved EB2 petition filed on 2011. That would remove the upper limit on my H1B i guess.

Once your new employee H1B visa (Premium processing) USCIS approved date onwards, you can start your work from new company.
