My wife has H1 till sept 2016; my H4 expired already, my H1B FY17 lottery is picked, should i travel to the US by extending my H4 to eliminate risk of stamping in India? Would I get stamping for H4 since my H1B is picked?
I assume you are outside US.
So you can appear for H-4 visa stamping and then travel to US on that visa. This can be done even if H-1 petition is under process. Once in US, you can apply for COS from H-4 to H-1 once your H-1 petition has been approved.
