I have an approved I-140 from my previous employer. It is not revoked and is still valid as i was working for that employer for more than 180 days after I-140 approval, but it is yet to be transferred to my current employer.
My wife is due for H4 EAD renewal. Can we go ahead with the H4 EAD renewal with the I-140 status as mentioned above?

An approved I-140 is the sole primary condition for H4 EAD issuance, approval and renewal. It is independent of your employer status but rather depends on you being ‘in-status’ at all times. Since that condition is already met, she can apply without concerns. Please note that the present administration keeps raising concerns about the H-4 EAD but that proposed rule is still not approved by house majority.
