H4 EAD in progress change to H1 COS

Hi ,

I am currently in US on H4 and have applied for H4 EAD last week. I also hold a H1B which i havent used it before. Now i have found an employer who is willing to do COS through cap exempt. If i do COS to H1 on premium processing will there be any problems cosidering the H4 EAD is in progress?

It should be ok. You have applied just for EAD and not the H-4 itself. So H-1 COS can be applied independently. Once H-1 COS is approved, EAD petition will become moot (if still pending).
