As per USCIS FAQ

A copy of the Form I-797 Receipt Notice for Form I-140 along with an explanation about why the Form I-797 Approval Notice is unavailable.Can you help me with sample explanation letter for I-140 Approval Notice is unavailable? as I have I-140 receipt number but Employer not providing copy of I-140 Approval Notice ,

You can say that employer is not willing to provide I-140 approval notice as per their policy. If the employer has declined in an email, then include copy of that email. Also include print out of online status showing that I-140 is indeed approved.

Mukesh, i was in the same boat … could you let me know if your spouse H4 EAD is approved ? if so can you le me know wt did you provide as support document in this case ?
