H4 and H1 status - as on Oct 1 2013

Hi ,

 I have a situation where , my H4 expiry date is Sep 31st 2013 . And my H1b is in process.And my husbands company want to file for his H1b extension. Advice me what to do now?

Im not clear on the USCIS " Last action rule" here. Im worried that i should not be back to my H4 status as on Oct 1 st 2013.

Since both will be valid from Oct 1st 2013.

Please advice.

  1. Upgrade your H-1 petition to PP, so that you know about its approval and then decide to file for H-4 extension or not.

  2. Have H-4 extension filed and if your H-1 gets approved, then withdraw the extension.
