Hi,

I have valid petition till 2021 and currently Amendment process is in progress due to the location change . The Amendment process went to RFE and USCIS expecting more documents as well ( All documents are submitted ) . As am planning to H1B transfer from Employer A to B. i have few questions on the transfer.

  1. As my amendment process is already in USCIS. the same time employer can file Visa transfer ?

  2. If they can then there is no problem on the transfer as one more process in progress ?

Please Suggest.

  1. yes, essentially your Transfer is a New H1B petition, just that you will be cap exempt.

  2. Yes, both are independent.

Filing transfer is a new petition and you are good to go. It will supersede the previous amendment.
