Hi,

My H1B Visa is Valid up to 01st April, 2017. In my current employer i don’t have onsite positions available. I haven’t entered US yet. Please guide me on below questions.

  1. Can I Shift to another employer and do the H1B Transfer from India?

  2. If possible, do i need approval from my current employer approval for H1B Transfer?

  3. If i shift to another employer, can i my current employer cancels H1B petition before H1B visa Transfer?

  4. Can I do H1B Transfer after cancellation of Petition also?

  5. Can I do H1B transfer after my Visa expiry date?

Hi Srini
Yes, you can transfer your h1b visa from India as well ,all you need to do is file your application through a new employer. If you do a H1B transfer your current employer can’t cancel it and you don’t need any approval from your current employer as well.
