H1B visa expiry and reuse!

Hi Expert,

Greetings!

My H1B was issued on 01.10.2005 and expired on 01.10.2008. I never use my H1B to enter USA.

Now i want to go to USA, is it possible to reuse the expired visa to apply under CAP-exempt category to get new H1B?

your H1 would be invalid (for CAP exempt use) after 6 years of its validity end date. Thus, you may not be able to use your invalid H1B petition after 2014 for cap exempt classification.
