H1B visa expiring in 4 months, need to file H4 visa, Travel to India

Hi Everyone,

I’m working for an Indian MNC on H1B visa in USA. My H1B visa is expiring on 15th April 2020 and I didn’t apply for an extension yet. This is my 6th year on H1B and I’ve I140 approved. I got married in December 2019 and need to apply H4 for my spouse. My brother’s wedding is planned for mid of March 2020 in India, which I can’t skip. I want to understand the best options that I’ve in my situation so that I can attend my brother’s wedding and get H4 visa for my spouse at the earliest.

While, you can apply for H4 Visa for your wife now and then go for stamping, the issue is you will only get 3 months of visa for her. As you anyways want to come back in march, the better thing to do is ask your employer to file for H1B extension soon in premium, get it approved and then attend the H1B and H4 interview together for your spouse, so that you will get new Visa for another 3 years…It also gives her and you the flexibility to travel around…
