H1b Visa expired and re-apply with new employer

Hi Saurabh,

I had a US-H1B Visa(Oct 2007-Sep 2010) which got expired in 13,Sep 2010. I got to know that I can re-apply for H1B VISA on the same petition, my questions are:

  1. Do I have any time limit to re-apply for H1B like expiry for my previous petition?
  2. If I go with new employer Do they need to pay only base fee or all other fees too?
  3. Is the process same for old employer or with new employer?
  4. How do I know whether my new employer is e-verified or not?

Thanks,
Kumar.G

  1. It needs to be done within 6 years of original approval.

  2. All fees need to paid by the new employer for the cap-exempt petition

  3. Process is same (both petitions are cap-exempt). With old employer fees will be lesser

  4. I think there are sites which allow you to enter employer information and then tell whether it is e-verified or not. But how does that matter to your H-1?
