Hi My husband worked for Employer A till March 2014, then his project ended, after that the employerA could not find him another one so he waited 3 months and applied H1B transfer to Employer B. Then he receieved RFE for payslips, When employer B filed H1B transfer in june they mentioned that he has payslips until March. So now USCIS is asking status for those 3 months. Meanwhile his Employer A ran the payroll and now he has payslips for those missing three months.
We did not have Payslips when Emplyer B filed H1B transfer, we received them later. He started working for Employer be upon the arrival of reciept number.
So my quesion is since Employer B mentioned on H1B transfer that he only worked till march, so if we provide thsoe 3 months payslips what will happen and what are the chances for approval or denial.
Employer B’s Attorney is saying that H1B transfer will be approved without recent payslips but he has to go out of country for stamping and come back on H1B.
Shall we send payslips for RFE or just continue with the original processing.
