H1B transfer

Hi there,

I am on H1B visa full time direct hire with company A and due my first time extension in October 2018. I found a company B, who is ready to hire me full time direct hire.

a) What will happen of they proceed for transfer and got denial?

b) Can I still work for my current employer or I will have to leave the country?

c) Can my current employer still file for an extension? Will my current employer ever know that some other company is doing the visa transfer?

a) What will happen of they proceed for transfer and got denial? - If you are joining them on receipt, I believe the only 2 options are either go back to previous employer (if they have not revoked) or leave the country. However, if your I-94 is valid, I believe the new employer can still re-apply. Please talk to an attorney.

b) Can I still work for my current employer or I will have to leave the country?- Refer to above.

c) Can my current employer still file for an extension? Will my current employer ever know that some other company is doing the visa transfer? - Current employer can still file extension. They will not know about the transfer.

Hi lionking,
I forgot to mention that I am still working with company A. I got an offer, so I have above questions before I take decision whether or not to accept it. I will quit this job only after the new company get approval of my visa transfer.
