My current H1B I797 and I94 expires : April 2022.
My last date at this company was 11th June 2020.
Due to 60 days grace period H1B rule, I need to find new employer and transfer my H1B latest by Aug 10, 2020 (by that date FedEx packet should have been received by USCIS)
I got a new employer who is ready to transfer my H1B, however they are telling me to
find one project asap so that we can have SOW, MSA, Client letter etc based on which
they can initiate my H1B transfer.
However, based on recent new rules, can I suggest my new employer that H1B transfer can be done now even though we do not have any SOW, MSA and client letter etc ?
Note:- I am still trying my best to get a new project (SOW/MSA/Client letter) but if at all I can not find , then I need to take some cutoff date (due to 60 days grace period limit) and may require to file H1B transfer without SOW, MSA etc
and if at all I file that way, do you recommend “Premium processing” in my scenario ?
