I have an approved H1B petition from Employer X. I received the H1B while I was in USA, and my joining date was 1st OCt. Now I have found another employer and he is willing to do a H1 transfer.
I dont have the approved I-797 or any document with me as I was in India while the H1 was approved.
Now is there any possibility that my H1 with the previous employer can be rejected as I never joined the compnay and I am looking for a transfer of emplyer. Can any employer cancell a approved H1B, if the employee doesn’t join
They can cancel the H-1, but you will still be considered to have made through the cap. This means another employer can file cap-exempt H-1 petition for you (aka H-1 transfer) now or after the previous petition has been canceled.
It is better to have a copy of the approved 797. If not, you can still go ahead w/ just the receipt number and print out of online approved status.
