H1b transfer & extension at same time

Hi,

One of my friend’s I94 & current h1b expiring mid mar 2020.
He got his h1b transfer approval for Emp B . His extension is filed under premium processing by his current employer A & is still in process. Can he start working for Employer B as of now ? If so ,What would happen if his extension gets approved? What about i94 he gets from his h1b extension? Will he be able to go back to employer A later if he wishes? Could you plz help in how best this scenario can be taken care of? Do we need to ask the Employer A to take back the extension? Plz help

Yes, he can work for B.
Nothing will happen, you need to inform them that you are working with B, so that they can withdraw it.
He may, provided if they have not withdrawn it.

  1. Suppose he starts working for B as his transfer to B approved. What would happen if his extension with A also gets approved? What about i94 he gets from his h1b extension? How will this impact him?

  2. Will he be able to go back to employer A later if he wishes?
