H1B transfer - Do I need Re-stamping for Employer change ?

Hi,

I have come to US in Nov 2012 with H1-B Visa stamped till August 2015.

I have changed my employer in May 2013 and got my H1B transfer Petition approved. However, in my Visa, my previous employer is mentioned.

I am planning to go to India in a weeks time and have few questions:

  1. Is it ok if my H1B visa has my old employer mentioned ( however I have the H1B transfer pettion approval with my current employer) ? Or do I need to get my H1B visa restamped with the new employer details ?

  2. My Passport got expired last month and when I got new passport re-issued, It has my father’s name misprinted with my name. However, my old passport (with the H1B visa) has the correct father name. Can this be an issue at the POE ?

Thanks in advance…

  1. It is allowed to re-enter US on H-1 petition through B and H-1 visa through A.

  2. No, it won’t be an issue.

Thanks Saurabh, appreciate your quick response.

So, at the CBP, if they see that my new passport has mismatching and incorrect fathers name compared to my old passport. It shouldn’t be an issue ? Because I will be carrying both, as my H1B visa is on old passport…

Please clarify…

Father’s name is not something they usually match.

I was looking for the same question. I got my answer through “suggestions by redbus”. Technology at its best.
Saurabh is the go to man. He is just awesome.
Thank you very much Saurabh.

My Question
PS: 1) Is it ok if my H1B visa has my old employer mentioned ( however I have the H1B transfer petition approval with my current employer) ? Or do I need to get my H1B visa re-stamped with the new employer details ?

That’s exactly what was answered above.
Yes, your situation should be fine.
