H1B to H4 VISA Transfer with 3 months left

Hi,
Currenlty my H1B extension is in progress and im in the 240 days period. My wife is also on H1B expiring on May 31st.

Due to family situation, I have to go back to India and plan to come on H4 on my wife’s H1B. I am aware that I cant work.

But my concern is “will my H4 petiton be denied since my wife’s H1b is only valid for 3 months?”

Not exactly, you should be able to get stamping. You can always say that the employer is filing for Extension after they return. Don’t worry. 3 months is a lot of time…
